Jack
Burgin's practice focuses on defending management
in employment discrimination, retaliation and wrongful
discharge claims, as well as advising and defending plan administrators and plan sponsors on compliance with the Employee Retirement Income Security Act of 1974. He also has litigated False Claims Act and Price
Anderson Amendment Act claims. After graduating with
honors from The University of Tennessee College of Law,
Mr. Burgin clerked for the Honorable Gary R. Wade, Judge
of the Tennessee Court of Criminal Appeals; from 1993
to 1996, he served as Editor of "DICTA," the
monthly publication of the Knoxville Bar Association.
He is the author of Sexual Harassment Law in Tennessee,
an online continuing legal education course offered
by the Tennessee Bar Association. Mr. Burgin currently serves as President of Appalachian Bear Rescue, a non-profit organization dedicated to the rehabilitation
of injured and orphaned black bear cubs. Mr. Burgin has represented management in the
following appeals: Adams v. Lockheed Martin Energy Systems, Inc., 199 Fed. Appx. 405 (6th Cir. 2006); Edwards v. Department of Energy, 200 Fed. Appx. 382 (6th Cir. 2006); Cannon v. Levi Strauss & Co., 29 Fed. Appx. 331 (6th Cir. 2002); Varnadore v. Secretary of Labor,
141 F.3d 625 (6th Cir. 1998); United States ex rel Fine
v. MK-Ferguson, Co., 99 F.3d 1538 (10th Cir. 1996).
Certification
as a labor and employment specialist is not currently
available in Tennessee.
